Opening statements began Friday in the rape trial for the son of a prominent attorney from the British Virgin Islands.
George Fay, 23, is charged with raping and forcing oral sex on a college student as she slept in an Upper East Side apartment, prosecutors said in Manhattan Supreme Court.
The 20-year-old victim went to Fay’s place at E. 72nd St. with a group of friends to crash after a night of drinking on July 9, 2016. The man she was with is a longtime buddy of Fay’s, prosecutors said.
“She thought she was safe. Instead, she woke up to this man, George Fay, penetrating her,” Assistant District Attorney Sara Sullivan told jurors.
“She shoved the defendant off her and she immediately became hysterical,” Sullivan said.
Fay grew up in in the British Virgin Islands — the son of well-known attorney Michael Fay — and attended schools in the U.S.
His lawyer told jurors the case is not as clear-cut as prosecutors wanted them to believe.
“There are substantial material and critical differences in the various statements she gave to both police and the other individuals involved,” said Stephen Saracco during opening arguments.
The trial resumes Monday.
